1. Introduction
Welcome to Chekku (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website accessibility scanning service available at chekku.dev (the “Service”).
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Description of Service
Chekku provides automated website accessibility scanning powered by the axe-core accessibility testing engine. Our Service scans websites for potential accessibility issues, provides plain-English explanations of detected issues, offers remediation guidance, and generates reports to help you improve your website's accessibility.
The Service includes:
- Automated accessibility scanning of web pages
- Desktop and mobile viewport testing
- Plain-English issue explanations and fix instructions
- Legal risk scoring and prioritization
- Scheduled automated scans and email alerts
- Score tracking and trend analysis
- PDF compliance reports (on eligible plans)
- AI-ready export formats for remediation assistance
3. Account Registration
To use the Service, you must create an account. You may register using email and password, or by authenticating through a third-party provider (Google).
For email/password registration, you must provide:
- A valid email address
- A secure password
- Your name (optional)
If you register using Google, you authorize us to access certain account information from Google, including your email address, name, and profile picture. By using third-party authentication, you also agree to comply with Google's terms of service.
You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly update your information if it changes
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access to your account
We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.
4. Subscription Plans and Billing
4.1 Plans
We offer a free plan and paid subscription plans. The specific features, usage limits, and pricing for each plan are presented in the Service (including at checkout) and may change over time.
- In-product terms control: If there is a conflict between marketing materials and what the Service enforces (for example, pages per scan, scan frequency, export/PDF availability, or email alerts), the in-product plan description and enforcement controls govern.
- Fair use / abuse prevention: “Unlimited” or high-limit features are subject to reasonable use and may still be constrained by technical and safety limits (for example: rate limits, concurrency caps, or temporary throttling) to protect our infrastructure, third parties, and target websites.
- Plan changes: We may add, remove, or modify plans, features, and limits at any time, and we may introduce additional restrictions to prevent abuse or comply with law.
4.2 Billing
Paid subscriptions are billed monthly in advance. Payments are processed securely through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.
You are responsible for any applicable taxes, and you agree that we may suspend or downgrade your access if payment is overdue, reversed, or disputed (e.g., chargeback) to the extent permitted by law.
4.3 Cancellation and Refunds
You may cancel your subscription at any time through your account settings or the Stripe customer portal. Upon cancellation:
- Your subscription will remain active until the end of the current billing period
- You will not be charged for subsequent billing periods
- Your account will revert to the Free plan after the paid period ends
All fees are non-refundable except where required by law. We do not provide refunds or credits for partial months, unused time, or failed scans caused by factors outside our control (for example, target site downtime, blocking, rate limiting, or authentication failures). However, we may offer refunds at our discretion in exceptional circumstances. Please contact support@chekku.dev for refund requests.
4.4 Price Changes
We reserve the right to modify our prices. For existing subscribers, price changes will take effect at the start of the next billing cycle following 30 days' notice via email.
5. Acceptable Use
You agree to use the Service only for lawful purposes. You may not:
- Scan websites you do not own or have explicit authorization to test
- Use the Service to conduct security testing, penetration testing, or vulnerability scanning beyond accessibility checks
- Attempt to circumvent rate limits, scan limits, or other restrictions
- Overload, disrupt, or interfere with the Service or its infrastructure
- Use the Service to collect, harvest, or process personal data in violation of applicable privacy laws
- Resell, sublicense, or redistribute the Service without our written consent
- Use automated means to access the Service in ways that exceed reasonable usage patterns
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Use the Service to scan illegal content or websites promoting illegal activities
We reserve the right to suspend or terminate accounts that violate this Acceptable Use policy.
6. Website Authorization
By adding a website to your Chekku account, you represent and warrant that you:
- Own the website or have explicit authorization from the owner to scan it
- Have the right to access any protected or authenticated areas you configure for scanning
- Will not use the Service to scan websites in violation of any applicable laws
If you are an agency or consultant scanning websites on behalf of clients, you are responsible for obtaining proper authorization from your clients before scanning their websites.
7. Intellectual Property
7.1 Our Property
The Service, including its design, features, content, and underlying technology, is owned by Chekku and protected by copyright, trademark, and other intellectual property laws. The Chekku name, logo, and associated branding are our trademarks.
7.2 Your Content
You retain ownership of the websites you scan and any data you provide to the Service. By using the Service, you grant us a limited license to access, scan, and analyze your websites solely to provide the Service.
7.3 Scan Results
Scan results, reports, and exports generated by the Service are provided for your use. You may use these results internally, share them with your team or clients, and incorporate them into your remediation workflow.
7.4 Feedback
If you provide suggestions, ideas, or feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that feedback for any purpose without compensation or attribution to you.
8. Important Disclaimers
8.1 Not Legal Advice
The Service does not provide legal advice. Scan results, legal risk scores, and compliance reports are provided for informational purposes only and should not be construed as legal guidance. We recommend consulting with a qualified attorney for legal advice regarding accessibility compliance and ADA requirements.
8.2 No Compliance Guarantee
We do not guarantee ADA compliance, WCAG conformance, or protection from legal action. Automated testing can identify many accessibility issues but cannot catch all problems. Some accessibility requirements require human judgment and manual testing. The Service is a tool to assist your accessibility efforts, not a substitute for comprehensive accessibility testing and expert review.
8.3 Limitations of Automated Testing
The Service uses the axe-core accessibility testing engine, which is an industry-standard automated testing tool. However, automated testing has inherent limitations:
- Automated tests can only catch approximately 30-40% of accessibility issues
- Some WCAG success criteria require human judgment to evaluate
- Dynamic content, complex interactions, and user experience issues may not be fully detected
- False positives and false negatives may occur
We recommend using the Service as part of a comprehensive accessibility program that includes manual testing and user testing with people with disabilities.
8.4 No Warranties; Service Provided “As Is”
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, accurate, or that scan results will be complete or meet your requirements.
8.5 Third-Party Services and Target Websites
The Service depends on third-party providers (for example, hosting, payments, background jobs, and scanner infrastructure) and interacts with third-party websites you choose to scan. We are not responsible for third-party outages, changes, or restrictions (including robots.txt, rate limiting, blocking, CAPTCHAs, or security controls) that prevent scans from running or affect scan results.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHEKKU AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages arising from accessibility lawsuits or legal claims
- Issues not detected by the Service
- Errors, omissions, or inaccuracies in scan results
- Service interruptions or downtime
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) $100 AND (B) THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages. If these laws apply to you, some or all of the above limitations may not apply.
10. Indemnification
You agree to indemnify, defend, and hold harmless Chekku and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of a third party
- Websites you scan without proper authorization
- Your failure to comply with applicable laws
11. Service Availability
We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled maintenance (we will provide advance notice when possible)
- Emergency maintenance or updates
- Factors beyond our control (network outages, hosting issues, etc.)
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. For significant changes affecting paid subscribers, we will provide reasonable notice.
12. Data and Content
12.1 Data Storage
We store scan results, site configurations, and account data to provide the Service. Please review our Privacy Policy for details on how we collect, use, and protect your data.
12.2 Data Retention
We retain scan history while your account is active and as needed to provide the Service. We may delete or aggregate older scan results over time (for example, retaining high level score history while removing detailed issue records), and retention may vary by plan, feature availability, or legal requirements. You may export your data while your account is active where export functionality is available.
12.3 Account Deletion
You may request deletion of your account and associated data by contacting support@chekku.dev. Upon deletion, your personal data and scan results will be removed, subject to any legal retention requirements.
13. Termination
By You: You may terminate your account at any time by canceling your subscription and contacting us to delete your account.
By Us: We may suspend or terminate your account if:
- You violate these Terms or our Acceptable Use policy
- We are required to do so by law
- Your account has been inactive for an extended period
- We cease offering the Service
Upon termination, your right to use the Service ends immediately. We may delete your account data, though we may retain certain information as required by law or for legitimate business purposes.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Except as provided in Section 15 (Dispute Resolution), any permitted legal action arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction and venue of such courts.
15. Dispute Resolution
15.1 Informal Resolution
Before initiating any formal legal action, you agree to first attempt to resolve any dispute informally by contacting us at support@chekku.dev. We will work in good faith to resolve disputes within 30 days.
15.2 Binding Arbitration (U.S. Residents; Where Permitted)
To the fullest extent permitted by applicable law, and after the informal resolution period above, you and Chekku agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by binding arbitration on an individual basis, rather than in court, except as set forth in the “Exceptions” subsection below.
Arbitration will be administered by the American Arbitration Association (AAA) under its applicable rules. The arbitration may be conducted by video, phone, or written submissions unless an in-person hearing is required by the arbitrator. The arbitrator may award the same remedies that a court could award, and the arbitrator's decision will be final and binding.
15.3 Class Action Waiver
YOU AND CHEKKU AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
15.4 Exceptions
Either party may bring claims in small claims court if the claims qualify, and either party may seek injunctive or equitable relief to prevent the unauthorized use or misuse of intellectual property or confidential information.
15.5 Opt-Out
You may opt out of the arbitration and class action waiver provisions by sending an email to support@chekku.dev within 30 days of first accepting these Terms. Your opt-out email must include your name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration.
16. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the “Last updated” date at the top of this page
- Notify you via email (for registered users)
- Provide a notice on the Service
Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
17. Miscellaneous
- Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Chekku.
- Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
- Waiver: Our failure to enforce any right does not waive our right to do so in the future.
- Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations freely.
- Force Majeure: We are not liable for failures due to circumstances beyond our reasonable control.
- Electronic Communications: By using the Service, you consent to receiving communications from us electronically (for example, email, in-app notices). You agree that these communications satisfy any legal requirement that communications be in writing.
